The European Commission imposes new anti-dumping duties on some goods categories

The European Commission has established three new implementing regulations regarding anti-dumping duties on the import of certain goods from China. In detail:

  • the Commission Implementing Regulation (EU) 2023/1775 of 14 September 2023  imposes a definitive anti-dumping duty on imports of certain seamless pipes and tubes of stainless steel originating in the People’s Republic of China;
  • the Commission Implementing Regulation (EU) 2023/1776 of 14 September 2023 imposes a definitive anti-dumping duty on imports of melamine originating in the People’s Republic of China. Melamine is a white crystalline powder produced mainly from urea and is mainly used for the production of laminates, resins, wood adhesives, molding compounds and paper/textile treatments;
  • the Commission Implementing Regulation (EU) 2023/1806 of 20 September imposes a definitive anti-dumping duty and definitively collecting the provisional duty imposed on imports of electric bicycles

 

Anti-dumping duties

Apart from regular customs duties, a product can also be subject to anti-dumping or other trade defence instruments.

Dumping occurs when a company exports a product at a lower price than the product’s normal value in its home market. This normal value could be the domestic price of the product, or the cost of production.

If an investigation finds that importers have engaged in dumping and this has caused injury to the domestic industry of the importing country, then anti-dumping measures can be imposed on imports of the product concerned.

The 2022 report on the EU’s trade defence activities, adopted today, shows that the European Commission has continued to be active and assertive in defending EU producers against unfair trade practices in 2022 by robustly applying the legislation and ensuring that measures are effective.

Some 177 measures were in place by the end of 2022, almost a fifth of which address circumvention practices.

The highest number of EU trade defence measures concern imports from China, Russia, India, Korea and the US. Thanks to the EU’s defence measures, almost half a million manufacturing jobs in the EU are protected, in sectors such as steel, aluminium, chemicals and ceramics.
